Mobile Coffee & Gelato Cart Policy

This Terms of Service Agreement ("Agreement") is in effect when a client purchases our mobile coffee and gelato cart services, whether through our website of via any LZ Dezigns staff. By booking our services, the Customer agrees to the terms and conditions outlined in this Agreement.

1. Booking and Payment:

1.1. To book our mobile coffee and gelato cart, the Customer must make a reservation by contacting us through our website at https://www.lzdezigns.com.au/ 

1.2. Full payment of the service is required at the time of booking to secure the reservation. 

1.3. Prices for our services are subject to change, but once a reservation is confirmed, the agreed-upon price will not change.

2. Cancellation and Refund Policy:

2.1. Cancellations made 14 days or more before the event date are eligible for a refund amount of 75% to account for any administrative and preparation costs for the event. 

2.2. Cancellations made within 7 days of the event date are not eligible for a refund, and the Customer is responsible for the full payment.

2.3. A Customer is responsible to have a sheltered backup plan with a power source in the event of rain or bad weather. Refunds will not be provided to a customers who do not provide a sheltered back up in the event of bad weather.

3. Event Details:

3.1. The Customer is responsible for providing accurate event details, including location, date, and time, to ensure the smooth delivery of our services.

3.2. Any changes to the event details must be communicated to the Company as soon as possible. We will make reasonable efforts to accommodate changes, but we are not responsible for disruptions caused by incorrect information.

4. Equipment and Set-Up:

4.1. The Company will provide all necessary equipment, including the mobile coffee and gelato cart, and set up at the specified event location.

4.2. The Customer is responsible for providing access to the event location and ensuring any required permits or approvals are obtained.

4.3. The Customer is responsible for providing a power and water source for the Company to set up all equipment. 

4.4. The Customer is responsible for ensuring the Company has a safe loading zone to unload and load the mobile coffee & gelato cart. Any fees or charges the Company incurs will be passed on to the Customer.

4.5. The Customer must ensure there is a safe way of moving the mobile coffee & gelato cart through the event location. The cart cannot be wheeled up steps or on soft surfaces, including but not limited to grass.

4.6. The Customer will ensure there is a flat hard surface for the Company to place the cart for service. Furthermore, the Customer will ensure the pathway from the Company vehicle to event space to transport the cart is also a hard surface. No grass, sand and the like, will be permitted. 

4.7. The Customer is required to provide the Company with a carspace for the duration of set up, service & pack up. 

5. Liability:

5.1. The Company shall not be liable for any injuries, damage, or losses that occur during the event. The Customer is responsible for the safety of their guests and property.

5.2. The Customer is responsible for any damages to the Company's equipment caused by the Customer or their guests.

6. Health and Safety:

6.1. The Company adheres to all applicable health and safety regulations and maintains proper hygiene standards during service.

6.2. The Customer is responsible for informing the Company of any allergies or dietary restrictions of their guests.

6.3. The Company staff will be the only people serving from the cart. 

6.4. The Customer cannot purchase their own product and require the Company to service another product from it's cart. 

6.5. The Company will be as accomodating as possible in using the Customer's product preference, however, all product must be purchased and serviced by the Company at all times. 

7. Termination:

7.1. The Company reserves the right to terminate the service if any disruptive or inappropriate behavior is displayed by the Customer or their guests or sheltered options are not provided by the Customer in the event of bad weather where the Company cannot continue services.

7.2. The Company reserves the right to terminate the service if the Customer does not specifiy the quantity of steps prior to the event and it exceeds more than one step.

7.3. The Company reserves the right to terminate the service if the Customer does not provide adequate access to power. 

7.4. The Company reserves the right to terminate the service if the Customer does not provide the Company with an undercover space to continue service, should there be bad weather where the Company can no longer provide service outdoors. 

7.5. The Company reserves the right to terminate the service if the Customer is deceitful in providing the Company with event details, including but not limited to non disclosure that the event is a wedding. The Company will not provide service if the Customer has been deceitful in any way, shape or form.

7.6. In the event of termination, no refund will be provided.

8. Intellectual Property:

8.1. The Company retains all rights to its branding, logos, and marketing materials.

9. Entire Agreement:

9.1. This Agreement constitutes the entire understanding between the Customer and the Company regarding the services provided and supersedes any prior agreements or understandings, whether written or oral.

By booking our mobile coffee and gelato cart services, the Customer acknowledges that they have read, understood, and agreed to these terms and conditions.
